We may also collect and process health-related personal data and medical history of the individual (e.g., patient) concerned by the complaint or report and who may have experienced the suspected adverse effects of the pharmaceutical product, if required for proper evaluation. We clarify that our Company, in order to fulfill its pharmacovigilance obligations under the legislation governing its pharmaceutical operations, must review and/or monitor any report it receives regarding alleged adverse reactions to its pharmaceutical products.

When you are a healthcare professional and we provide any benefit to you (such as donations, sponsorships, registration fees for conferences and scientific events for the medical community, as defined in the relevant circulars of the National Organization for Medicines – EOF) based on contract or voluntarily in relation to the promotion of prescription medicines, we collect and process specific personal data such as your full name, contact details, and information concerning the benefits and our contractual relationship.

We also collect and process specific categories of your personal data when you submit a job application to CROSS as a prospective employee, including your identification and contact details, information regarding your education and professional experience, and your CV. When you subscribe to our newsletter by completing the relevant Website form, we collect and process your email address in order to send you the relevant material.

Disclosure of Personal Data Related to the Promotion of Medicinal Products

In accordance with applicable legislation, our Company, as a pharmaceutical entity, is obligated to publicly disclose, both on its own website and on the dedicated website of the National Organization for Medicines (EOF), no later than six months after the end of each calendar year, any benefit provided to third-party Healthcare Professionals and Scientific Healthcare Institutions. Such benefits include, but are not limited to, donations, sponsorships, registration fees for medical congresses and scientific events, travel and accommodation expenses, as well as any other provision granted under contract or voluntarily (e.g., donation, sponsorship), related to the promotion of prescription medicines. In fulfilling its legal obligations, our Company publishes the relevant information on our Website, which may include personal data of third parties (e.g., personal data of healthcare professionals). The information will remain publicly available on our Website for a maximum of three (3) years.

4. Legal Basis for Processing

We process your personal data when the law permits us to do so, that is, when we have a legal basis for the processing, specifically when:

–              You have provided your consent for the processing of the data for one or more specific purposes (e.g. for the installation and use of certain optional types of cookies, when you subscribe to our newsletter, when you create an online registration account on the Website as a doctor to access product information material, when you contact us directly), in accordance with Article 6(1)(a) of the GDPR, as well as Article 9(2)(a) of the GDPR.

–              The processing of your personal data is necessary for us to comply with our legal obligations, as well as to protect public health, as in the case of pharmacovigilance activities (see JMD DYG3a/GP 32221/2013), in accordance with Article 6(1)(c) of the GDPR, as well as Article 9(2)(i) of the GDPR. It should be noted that the processing act of disclosing the data of health professionals and any benefits our Company may provide to them for the promotion of prescription medicines is also necessary to comply with our legal obligations (see Article 66(7a) of Law 4316/2014), in accordance with Article 6(1)(c) of the GDPR.

–              The processing of your personal data is necessary for the performance of our contract (e.g. in the case of sponsorship by our Company to a health professional), in accordance with Article 6(1)(b) of the GDPR.

–              The processing is necessary for the purposes of the legitimate interests pursued by CROSS, provided that your fundamental rights do not override such interests, in accordance with Article 6(1)(f) of the GDPR. Such legitimate interests include: (a) monitoring to ensure the effective and secure operation of our Website and to prevent fraud and misuse, (b) optimizing our Website, (c) monitoring how our Website functions, e.g. through statistical data, in order to improve the design and information provided through our Website.

5. Retention period of personal data

Your personal data will be retained for as long as required to fulfill the purposes for which it may be collected, e.g., for as long as it is necessary to provide you with the functions of our website and the services you requested. Once the purpose for processing your personal data has been fulfilled, we will either delete your personal data or anonymize it, unless there are legal reasons requiring its retention. Specifically:

  • We retain your personal data collected from you as a healthcare professional in case we provide you with benefits for the promotion of prescription drugs for as long as required during our contractual relationship and for as long as required by law after its termination, in order to fulfill our legal obligations (e.g., tax legislation) and until any related claims are time-barred.
  • We retain your personal data collected when you send us a job application following a job announcement until the position is filled. If you send a job application unsolicited (without a relevant announcement from us) and if we are not interested in a potential collaboration, your personal data is deleted one month after the date we received your application. In the event your application is rejected, if you request us to retain your application and related personal data (e.g., CV) in order to inform you about potential future job opportunities, we will retain your personal data for the period for which you have given your consent, or until you withdraw your consent before the end of that period.   • We retain your personal data collected during your subscription to our newsletter (e.g., email address), for as long as you remain subscribed to our recipient list, and delete it upon withdrawal of your consent.
